Keno Bonus - Win a share of $100,000 in Gold Promotion

  1. The Keno Bonus Win a share of $100,000 in Gold Promotion, 2011 (the "Promotion") will commence at 10.00am AEDST on Monday 14 November, 2011 and closes at 14.00pm AEDST on Sunday 18 December 2011 (the "Promotional Period").
  2. In order to participate in the Promotion, persons must be over 18 years of age, an Australian resident, and NOT have been excluded (whether self-excluded or otherwise) from participation in the game of Keno or excluded from a venue in which the Promotion is taking place.
  3. To enter into the Promotion, an eligible person must purchase a Keno ticket (which includes a "Bonus" element for one or more of the Keno games) valued at $10 or more ("Qualifying Keno Ticket") at the venue within the Promotional Period ("Entrant").
  4. Immediately following an Entrant's purchase of a Qualifying Keno Ticket, a Keno terminal generated entry form ("Entry Form") for the Promotion will be generated to an Entrant, provided it is purchased during the Promotional Period.
  5. Entrants may submit unlimited Entry Forms into the Promotion during the Promotional Period.
  6. To enter into the Promotion for a chance to win a Major Prize an Entrant must, having purchased their Qualifying Keno Ticket during the Promotional Period, complete the Keno terminal generated Entry Form with their full name, phone number and contact details and place it into the allocated entry box at the participating venue from which the Entrant purchased their Qualifying Keno Ticket.
  7. Entries into the Major Prize Draw are valid at the venue of purchase only.
  8. All entries into the draw for the Major Prize (in the event that the venue from which the Entrant purchased their Qualifying Keno Ticket is a Selected Venue for a Major Prize Draw) will be automatically included in the draw for the Venue Prize.
  9. To enter into the Promotion for a chance to win a Venue Prize an Entrant must, having purchased their Qualifying Keno Ticket during the Promotional Period, complete the Keno terminal generated Entry Form with their full name, phone number and contact details and place it into the allocated entry box at the participating venue from which the Entrant purchased their Qualifying Keno Ticket.
  10. Entries into the Venue Prize Draw are valid at the venue of purchase only.
  11. All entries into the draw for the Venue Prize will first be automatically included in the draw for the Major Prize, in the event that the venue from which the Entrant purchased their Qualifying Keno Ticket is one of the Selected Venues for a Major Prize draw.
  12. There are two (2) Major Prizes to be won in the Promotion, one from participating venues in New South Wales and one from participating venues in Queensland.
  13. Each Major Prize consists of, at each Prize Winner's election, either ("Major Prize"):
  14. The maximum total value of the Major Prizes, together, is $100,000.
  15. If the Major Prize Winner elects to take the Gold Major Prize, the Promoter will purchase the gold at the prevailing Australian gold price as of 21st December, 2011. The Promoter will also pay for freight and travel insurance of the Gold Bar within Australia. The two (2) Major Prize Winners will be responsible for collecting their Major Prize from the venue at which the Major Prize Winner entered the Promotion, at a time and date specified by the Promoter. The Promoter may, in its absolute discretion, elect to deliver the Gold Major Prize to a Major Prize Winner's nominated home address if the Major Prize Winner resides in a regional location.
  16. Participating venues will choose (entirely in each participating venue's discretion) either Venue Prize Pack A or Venue Prize Pack B as the venue prize available to be won at their venue ("Venue Prize").
  17. Venue Prize Pack A consists of one (1) $350 Keno KASH EFTPOS Card which can be used at any retail business in Australia where Eftpos payment is accepted, with a total recommended retail value of $350.00 ("Venue Prize Pack A").
  18. Venue Prize Pack B consists of one (1) $150 Keno KASH EFTPOS Card which can be used at any retail business in Australia where Eftpos payment is accepted, with a total recommended retail value of $150.00 ("Venue Prize Pack B").
  19. The Venue Prizes will be valid for a 6 month period commencing on the date of card activation by the Venue Prize Winner. The Venue Prize can be activated online at www.giftcardplanet.com.au/kenobonuspromotion and must be activated within 3 months from the date of issue. The Venue Prizes will be subject to Edge Loyalty's terms and conditions as advertised at www.giftcardplanet.com.au/kenobonuspromotion. The Venue Prizes cannot be used to withdraw cash.   20. Each participating venue will display and advertise the relevant Venue Prize available to be won at their venue.
  21. Each Venue Prize Winner must make their own arrangements to collect their Venue Prize from the venue at which it was won. It is not the responsibility of the Promoter or the relevant participating venue to deliver a Venue Prize to a Venue Prize Winner and the 6 month validity period will commence from the date of the Venue Prize being activated by the Venue Prize Winner.
  22. One (1) venue in NSW will be randomly selected from all NSW participating venues and one (1) venue in QLD will be randomly selected from all QLD participating venues to each conduct a Major Prize Draw ("Selected Venues"). A Major Prize will be drawn at both the NSW and QLD Selected Venues. The Selected Venues will be drawn by the Promoter at Level 2, 495 Harris Street, Ultimo, NSW. The Selected Venues will be notified by 14:00pm AEDST on Monday 19 December 2011 that they have been drawn as a Selected Venue and must draw a Major Prize Winner.
  23. A Major Prize draw will be conducted at each of the Selected Venues on or after 11.00am AEDST on Wednesday 21 December 2011 in order to determine the Major Prize Winners.
  24. The Promoter's decision about the draw of a Selected Venue and the draw of a potential Major Prize Winner from a Selected Venue is final.
  25. Each of the Major Prize Winners will be notified by phone and/or mail on and from Wednesday 21 December 2011, and within 2 days of the Major Prize Draw date, using the contact details supplied by the Major Prize Winner on their Entry Form. If the Major Prize Winners can be contacted by telephone, or they respond to the Promoter's written notification, within 90 days of the Major Prize Draw, then the Major Prize Winners will win their respective Major Prize, subject to these Terms and Conditions.
  26. If a Major Prize Winner cannot be contacted within 90 days after the Major Prize Draw, or if the Major Prize Winner is not properly identified or eligible in accordance with paragraphs 2, 3, 36 and 41 that Major Prize Winner will be deemed to have forfeited any entitlement to their Major Prize. An additional draw will take place for each forfeited Major Prize on Wednesday 21 March 2012 at 11:00am AEDST at the Selected Venue.
  27. Should the re-draw referred to in paragraph 26 occur, the Entrant whose entry is drawn in the re-draw will win the Major Prize in place of the ineligible Major Prize Winner, subject to these Terms and Conditions. If the new Major Prize Winner can be contacted and identified in the manner set out in paragraphs 24, 2, 3, 36 and 41 within 90 days of the re-draw, that Entrant will then become a Major Prize Winner for the purposes of these Terms and Conditions and the Promotion.
  28. Each participating venue will conduct one (1) Venue Prize draw at their premises on or after 11am AEDST on Wednesday 21 December 2011.
  29. Each Venue Prize Winner will be notified by phone and/or mail by their participating venue on and from Wednesday 21 December 2011, and within 2 days of the Venue Prize draw date, using the contact details supplied by the Major Prize Winner on their Entry Form. If the Venue Prize Winners can be contacted by telephone, or they respond to the Promoter's written notification, within 90 days of the Venue Prize Draw, then the Venue Prize Winners will win their respective Venue Prize, subject to these Terms and Conditions.
  30. If a Venue Prize Winner cannot be contacted within 90 days after the Venue Prize draw, or if the Venue Prize Winner is not properly identified or eligible in accordance with paragraphs 2, 3, 36 and 41 that winner will be deemed to have forfeited any entitlement to their Venue Prize. An additional draw will take place for each forfeited Venue Prize on Wednesday 21 March 2012 at 11.00am AEDST at the participating venue.
  31. All Venue Prizes which remain uncollected after 90 days, or if a Venue Prize Winner has not made arrangements with the venue to collect their Venue Prize at a later date, will be deemed to have been forfeited by the Venue Prize Winner and will be redistributed in accordance with the re-draw provisions outlined in item 30.
  32. Should a re-draw referred to in paragraphs 30 and 31 occur, the Entrant whose entry is drawn in the re-draw will win the Venue Prize in place of the ineligible Venue Prize Winner, subject to these Terms and Conditions. If the new Venue Prize Winner can be contacted and identified in the manner set out in paragraphs 29, 2, 3, 36 and 41 within 90 days of the re-draw, that Entrant will then become a Venue Prize Winner for the purposes of these Terms and Conditions and the Promotion
  33. It is the responsibility of the participating venue to provide the Promoter with the name and contact details of the Venue Prize Winners.
  34. Each Prize Winner's details (including, for the avoidance of doubt, Major Prize Winners and Venue Prize Winners) will be published at www.playkeno.com.au from the next business day from the Major Prize Draw and the Venue Prize Draw for a period of 90 days from their respective draw dates.
  35. Major Prize Winner's details will also be published in The Australian newspaper on Friday 23 December 2011 (and, to the extent that a re-draw of any Major Prize is required in accordance with item 26 the re-drawn winner's details will be published in The Australian newspaper on Friday 23 March 2012).
  36. If the Promoter reasonably suspects that a Prize Winner (including, for the avoidance of doubt, Major Prize Winners and Venue Prize Winners) is not eligible, has breached these Terms and Conditions or has acted improperly to increase their chances of winning the Prize, the Promoter reserves the right to refuse to award the Major Prize or a Venue Prize and to conduct a re-draw in accordance with the procedure set out in these Terms and Conditions.
  37. All Prizes must be taken as offered and cannot be varied. All Prizes are not transferable. The Promoter is not responsible for any lost, stolen or damaged Prizes. Subject to the consumer guarantees set out in Division 1 of Part 3-2 of the Australian Consumer Law (as defined in the Competition and Consumer Act 2010 (Cth) (the "Consumer Guarantees"), the Promoter does not warrant the merchantability, suitability and/or fitness for purpose of any goods and/or services awarded as a Prize (if any).
  38. The Promoter will not be responsible or liable if for any reason beyond their reasonable control, a Prize (or part of any Prize) is unavailable. The Promoter, in its discretion, reserves the right to substitute a Prize (or that part of a Prize) with an alternative prize to the equal value and/or specification, unless to do so would be prohibited by law and subject to the Consumer Guarantees and to any written directions from a regulatory authority.
  39. Information on how to enter, and the Prize itself, form part of these Terms and Conditions. Participation in the Promotion by an Entrant (and acceptance of a Prize by a Prize Winner) confirms their acceptance of the Terms and Conditions governing the Promotion.
  40. Directors, management and employees of the Promoter and their immediate families are not eligible to participate in this Promotion. Immediate family means any of the following: spouse, de-facto spouse, child or step-child (whether natural or by adoption).
  41. The Promoter reserves the right to request a Prize Winner provide proof of age and identity prior to awarding a Prize. Identification considered suitable for verification is at the discretion of the Promoter. A Prize Winner may be required to complete a statutory declaration to confirm their eligibility to accept a Prize.
  42. In the event of war, terrorism, state of emergency, disaster or for any reason whatsoever beyond the reasonable control of the Promoter, the Promotion is not capable of being conducted as reasonably anticipated, the Promoter reserves the right (unless doing so would be prohibited by any law including the consumer guarantees set out in the Consumer Guarantees) to cancel, terminate, modify or suspend the Promotion subject to any written directions from the NSW Office of Liquor, Gaming and Racing.
  43. Decisions of the management of the Promoter are final. No correspondence will be entered into. To the extent that a situation or issue arises for which these Terms and Conditions make no provision or in relation to which the relevant Terms and Conditions are unclear, the Promoter reserves the right to make a decision regarding such situation or issue in its sole and absolute discretion and such decision will be final and binding.
  44. Each Entrant consents to the Promoter using (or permitting authorised third parties to use) the Entrant's name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this Promotion (including any outcome), the Promoter and or products/services supplied by the Promoter.
  45. The Promoter will collect, use and disclose the Entrant's Personal Information (as defined under the Privacy Act 1988 (Cth)) in order to administer and conduct the Promotion, carry out any activities connected with or related to the Promotion and provide any related or ancillary goods/services. The Entrant's Personal Information may also be used and disclosed in accordance with any other terms and conditions previously agreed to by the Entrant (if any) and in accordance with the relevant privacy policy of the Promoter. If an Entrant does not provide the Promoter with the Personal Information requested by the Promoter, the Promoter may not permit the Entrant to participate in the Promotion. By entering the Promotion, the Entrant consents to the Promoter: (a) collecting and using the Entrant's Personal Information in relation to the purposes referred to above; and (b) where considered necessary by the Promoter, disclosing the Entrant's Personal Information to third parties, including, but not limited to, Prize suppliers or regulatory authorities and for any purpose to which the Entrant has previously consented, including but not limited to, future promotional, marketing and publicity purposes. Entrants should direct any request to access, update or correct their Personal Information to the Promoter using the contact details set out below. All Entry Forms become the property of the Promoter.
  46. Except for any implied condition or warranty (including any applicable Consumer Guarantee) the exclusion of which from these Terms and Conditions would contravene any statute or cause any part of these Terms and Conditions to be void ("Non Excludable Condition"), the Promoter excludes from these Terms and Conditions all conditions, warranties and terms, implied by statute, general law or custom. Except for any liability in relation to a Non Excludable Condition, the Promoter (including its officers, employees, contractors and agents) excludes all liability whether arising in tort (including, without limitation, negligence), contract or otherwise for any personal injury or any other loss, damage, cost, expense, damage or claim suffered, sustained or incurred (including without limitation loss of opportunity or loss of profits) whether direct, indirect, special or consequential, arising either directly or indirectly out of or in connection with the Promotion or the Prize, including (without limitation) the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost altered, damaged or misdirected (whether or not after receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these Terms and Conditions; (e) any tax implications; (f) the cancellation or postponement of an event which constitutes the prize; and/or (g) a Prize or use of a Prize
  47. The Promoter is not responsible for lost, late, damaged, misdirected, incomplete or ineligible Entry Forms.
  48. All Prize values are in Australian dollars. Promotional pictures may not represent the actual prize.

The laws of the state of New South Wales govern the Promotion to the extent that the Promotion is conducted in relation to a prize draw from participating Keno venues located in New South Wales. The laws of the state of Queensland govern the Promotion to the extent that the Promotion is conducted in relation to a prize draw from participating Keno venues located in Queensland
